PROPERT GUARDIAN TERMS AND CONDITIONS

PLEASE REVIEW THESE TERMS & CONDITIONS CAREFULLY

These Terms and Conditions govern the responsibilities and rights of Property Guardians under the guardianship arrangement facilitated by Support&match CIC and Supportmatch Homeshare Ltd. By entering into this agreement, you agree to the following terms, designed to maintain safety, compliance, and respect within the property you will be occupying.

By submitting your application, you agree to these Terms & Conditions.


1. DEFINITIONS
      • 1.1 Property Guardian: An individual who occupies a property under a guardianship arrangement, paying a Licence Fee, and optionally providing light domestic assistance and/or companionship for up to 3 hours per week to the Property Owner.
      • 1.2 Licence Fee: A payment made by the Guardian to the Property Owner via Support&Match CIC for the right to occupy the property, distinct from rent and not subject to tenancy laws.
      • 1.3 Property Owner: The legal proprietor of the property or an individual authorized to manage and sublet the property.
      • 1.4 Support&Match CIC: A Community Interest Company facilitating the guardianship arrangement.
      • 1.5 Supportmatch Homeshare Ltd: A UK-registered Limited Liability Company facilitating a Homeshare Arrangement.
      • 1.6 Supportmatch Group: Supportmatch Group refers collectively to Support&Match CIC, a Community Interest Company registered in the UK, and Supportmatch Homeshare Ltd, a UK-registered Limited Liability Company. Each entity within the Supportmatch Group operates independently but collaborates to facilitate Guardianship and Homeshare arrangements under their respective agreements and responsibilities.
      • 1.7 Domestic Assistance: Light household tasks, such as cleaning, gardening, or rubbish removal, provided for up to 3 hours weekly.
      • 1.8 Property: The residence provided to the Guardian for temporary occupation under the Licence Agreement.

2. LICENCE FEE AND PAYMENT TERMS
      • 2.1 The Guardian agrees to pay a monthly Licence Fee on the 1st day of each month in advance. The fee includes utility costs unless explicitly stated otherwise in the agreement.
      • 2.2 The Licence Fee is non-refundable if the Guardian breaches the terms of this agreement.
      • 2.3 Late payments may incur interest at a rate of 4% above the Bank of England base rate per annum, calculated daily from the due date until payment is received.

3. PROHIBITION OF DRUG USE
      • 3.1 The use, possession, storage, or sale of illegal drugs, including but not limited to cannabis and Class A substances, is strictly prohibited within or outside the immediate location of the property.
      • 3.2 Guardians must not allow illegal drugs to be brought into the property by visitors or acquaintances.
      • 3.3 Any Guardian found in violation will face immediate termination of their guardianship agreement, with law enforcement notified where applicable.

4. PROHIBITION OF ALCOHOL ABUSE
      • 4.1 Moderate alcohol consumption is permitted, provided it does not lead to disruptive or unsafe behaviour.
      • 4.2 Guardians must not allow alcohol-related disturbances or unsafe conditions caused by visitors or other occupants.
      • 4.3 Alcohol abuse, defined as excessive consumption leading to disturbances, safety risks, or property damage, will result in immediate termination of the agreement.

5. DUTY TO MAINTAIN A SAFE ENVIRONMENT
      • 5.1 The Guardian must keep the property clean, tidy, and free of hazards.
      • 5.2 Any damage, health and safety concerns, or necessary repairs must be reported promptly to the Property Owner and Support&Match CIC (cic@supportmatch.co.uk or admin@supportmatch.co.uk).
      • 5.3 Unauthorised modifications to the property are strictly prohibited.
      • 5.4 Key Management and Replacement Costs. The Guardian is responsible for the safekeeping of all keys provided to access the property. In the event that keys are lost, misplaced, or stolen, the Guardian agrees to bear the full cost of replacing the keys and any associated locks required to maintain the security of the property. Such costs will be determined by the Property Owner and/or Support&Match CIC and will be invoiced to the Guardian for payment within 14 days.

6. ANTI-SOCIAL BEHAVIOUR AND COMMUNICATION
      • 6.1 Respectful Behaviour: Guardians must respect the Property Owner, neighbours, and other occupants. Anti-social behaviour, such as excessive noise, harassment, or intimidation, is prohibited.
      • 6.2 Respectful Communication: All communication with the Property Owner and Support&Match CIC must be courteous and professional. Hostile or disrespectful communication is grounds for termination.
      • 6.3 Immediate Termination Clause: Anti-social behaviour or communication breaches will lead to immediate termination of the guardianship agreement.

7. VISITORS
      • 7.1 No overnight visitors are allowed under any circumstances.
      • 7.2 Day visitors are permitted but require prior approval from the Property Owner. The Property Owner reserves the right to deny visitor requests or set specific terms for day visitors.
      • 7.3 Visitors must adhere to all property rules, and the Guardian will be held accountable for their conduct. Any violations of these rules by visitors may result in termination of the agreement.

8. DOMESTIC ASSISTANCE AND RESPONSIBILITIES
      • 8.1 Guardians provide up to 3 hours of light domestic assistance weekly to secure affordable accommodation, as agreed with the Property Owner.
      • 8.2 Responsibilities include light cleaning, gardening, or other tasks agreed upon. Guardians are not required to provide professional care or extensive domestic help.

9. LEGAL COMPLIANCE
      • 9.1 The Guardian acknowledges this agreement does not create an Assured Shorthold Tenancy (AST) and provides no tenancy rights.
      • 9.2 Guardians must comply with all relevant laws, including the Misuse of Drugs Act 1971 and the Licensing Act 2003.

10. CONFIDENTIALITY AND DATA PROTECTION
      • 10.1 Personal data shared during the guardianship arrangement will be managed per the GDPR and the Supportmatch Group’s privacy policies (Privacy Policy – SUPPORTMATCH HOMESHARE).
      • 10.2 Guardians must treat any confidential information about the Property Owner or property with care and not disclose it to unauthorised parties.

11. TERMINATION
      • 11.1 Notice Period: Either party may terminate this agreement by providing 30 days’ written notice.
      • 11.2 Immediate Termination: The agreement may be terminated without notice if the Guardian breaches terms related to anti-social behaviour, legal compliance, or safety.
      • 11.3 Upon termination, the Guardian must vacate the property, leaving it in a clean and tidy condition, and remove all personal belongings.

12. PROPERTY USE
      • 12.1 The property must only be used for the purpose outlined in this agreement. Guardians may not operate businesses or sublet the property.

13. INSURANCE
      • 13.1 Guardians are advised to obtain personal contents insurance for their belongings.
      • 13.2 The Property Owner is not liable for loss, theft, or damage to the Guardian’s personal items.

14. CHANGES TO TERMS AND CONDITIONS
      • 14.1 The Supportmatch Group reserves the right to amend these Terms and Conditions at any time.

15. NON-CIRCUMVENTION
      • 15.1 To maintain the integrity of Support&Match CIC’s services, Property Guardians and Property Owners are strictly prohibited from circumventing the fees or services provided by the Supportmatch Group at any time, including but not limited to the period during which a Property Guardian is introduced to a potential Property Owner.
      • 15.2 Any attempt by a Property Guardian to Circumvent the Supportmatch Group, whether by direct negotiation, proposing alternative arrangements, or otherwise engaging in direct dealings with a Property Owner introduced by the Supportmatch Group, constitutes a material breach of these Terms and Conditions.
      • 15.3 In the event of such a breach, the Guardian will be held liable for damages equivalent to 3–12 months’ Licence Fees under this agreement, as determined by the severity and impact of the circumvention.
      • 15.4 The Supportmatch Group reserves the right to pursue all necessary legal remedies, including seeking an injunction or financial compensation, to protect its services and reputation.
      • 15.5 By submitting your application, you acknowledge and accept that non-circumvention obligations begin from the point of introduction to a Property Owner and continue for a minimum of three (3) years following termination of the guardianship arrangement.
